The debt was reported to the collection agency as being 60 days past due, which with proof is not correct, the account is current for another week. Now there are incorrect billing amounts. It appears it was inaccurately reported to the collection agency by this other company, is this legal?
Can a collection agency try to collect a debt that is not past due?
Don't worry about whether it's legal. It's a mistake. Have the company fix the mistake and the collector problem goes away.
Reply:Contact the original creditor and ask them to fix the problem and also tell the collection agency. You might also want to send the collection agency a letter requesting verification of the debt.
Reply:You need to contact the Original Creditor about this situation. Sounds to me that it is past due the time it takes to notify the collection agency and the time it takes the agency to send you out a letter asking for payment is gonna be no less than 2 weeks. For this to happen the original creditor would've sent it to them right away instead of waiting for any insurance or payment from you.
