I'm being sued, and I want to find out if a lien can be placed against my home for credit card debt. Will I have clear access to the title if I ever decide to sell.
Can a lien be placed against your home for credit card debt in Texas? I know they can for contractor debt?
Yes they can if they take you to court and get a judgment, they can also attach bank accounts but can not garnish wages in Texas.
They can not take your home but if you sell it the lien will have to be paid out of the profits.
Reply:A Texas judgment lien only attaches to real estate you own. It has no effect on your personal property.
If you own a home in Texas. You would, of course, assume that your debt attaches to your home. But, it doesn't. Texas exempts your personal residence from the power of a judgment lien. It's called a "homestead exemption."
Even though your debt doesn't attach to your homestead, it does create a cloud on the title to your home. In other words, your creditors can make it difficult for you to sell your home because your lien creates a question of ownership.
Reply:Credit card debt is unsecured debt. They can't place a lien on your home as far as I know. There really isn't much they can do.
